Website Terms of Use and Donation Terms

These terms apply to use of https://www.mtimaheartfoundation.org and donations made through the site. The site is operated by Mtima Heart Foundation, a charitable incorporated organisation registered in England and Wales under charity number 1211684, with its principal contact address at The Piccadilly Business Centre, Unit C, Aldow Enterprise Park, Blackett Street, Manchester, M12 6AE, United Kingdom. By using the site, you agree to these terms. Nothing in them excludes rights that cannot lawfully be excluded.

Use of the website

  • Use the site only lawfully and do not attempt unauthorised access, introduce malicious code, interfere with availability, scrape personal information or impersonate another person.
  • Content is provided for general information and charitable engagement. It is not professional, legal, financial, medical or safeguarding advice.
  • We may change, suspend or withdraw parts of the site and do not guarantee uninterrupted or error-free availability.

Donations

A donation is a voluntary gift to MHF. You can make a one-time or recurring donation. Online donations are facilitated by Fundraise Up, and payment is processed by the provider shown at checkout, such as Stripe or PayPal. You confirm that you are authorised to use the payment method and that the funds are lawful. We may decline, pause, return or investigate a donation where required for safeguarding, sanctions, fraud, reputational or regulatory reasons. Information about you and your donation is handled as described in our Privacy Notice.

Restricted appeals and surplus

Where an appeal clearly states a restricted purpose, MHF will apply funds to that purpose. If an appeal for a named or described child raises more than the verified current amount, MHF may use the surplus for that child’s future eligible educational needs where the appeal says this. If the intended purpose becomes impossible, impracticable or fully met and the appeal did not provide a suitable alternative, trustees will act under charity law and seek any required authority before redirecting restricted funds.

Recurring donations

A recurring donation continues at the interval and amount shown at checkout until cancelled. Donors may manage or cancel a recurring donation through the Fundraise Up Donor Portal where available, through their payment provider, or by contacting MHF. Cancellation affects future payments and does not normally reverse payments already processed.

Refunds and errors

Charitable donations are generally non-refundable. We will consider a prompt request where there has been an error, duplicate payment, unauthorised transaction or other exceptional reason. Contact info@mtimaheartfoundation.org with the transaction details. Refunds are normally returned to the original payment method after reasonable checks. Statutory rights and payment-provider dispute rights are unaffected.

Gift Aid

A donor who makes a Gift Aid declaration is responsible for ensuring the declaration is accurate and that enough UK Income Tax and/or Capital Gains Tax is paid to cover the Gift Aid claimed on all donations in the relevant tax year. Donors must tell MHF if their circumstances or address change or if the declaration should be cancelled. Gift Aid is claimed only after MHF is authorised and has implemented compliant records and processes.

Intellectual property and links

Unless stated otherwise, MHF owns or is licensed to use the site content. You may view and share links for personal, non-commercial and lawful purposes with attribution, but may not reproduce substantial content, remove notices or imply endorsement without permission. Links to third-party sites are provided for convenience; MHF does not control their content or privacy practices.

Liability

To the fullest extent permitted by law, MHF is not liable for loss arising solely from reliance on general website content, site unavailability, third-party content or events outside reasonable control. We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.

Privacy governing law and contact

Use of personal information is explained in our Privacy and Cookie notices. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory consumer rights. Contact info@mtimaheartfoundation.org. Effective 21 September 2026.
